What is a proposed endeavor in an NIW petition?

The proposed endeavor is the specific work the individual intends to pursue in the United States. It should be more precise than merely naming an occupation, employer, or industry. A useful description explains the problems being addressed, planned activities, geographic or sector reach, intended customers or beneficiaries, implementation method, expected outcomes, and the person’s role. A business plan can provide this forward-looking structure for an entrepreneurial or commercially oriented endeavor.

What do substantial merit and national importance mean?

Substantial merit may be demonstrated in fields such as business, entrepreneurship, science, technology, health, education, culture, or other areas of value. National importance focuses on the prospective impact of the specific endeavor rather than the general importance of an industry or profession. Relevant factors can include broader economic implications, industry advancement, dissemination, public benefit, critical needs, job creation, or effects extending beyond one company’s ordinary commercial interests.

How does a petitioner show they are well positioned to advance the endeavor?

USCIS may consider education, expertise, skills, accomplishments, prior results, a record of related success, detailed plans, progress already made, customer interest, contracts, funding, partnerships, intellectual property, publications, awards, recommendation letters, and other support. No single type of evidence is mandatory in every case. The question is whether the total record credibly shows that the person is positioned to move the proposed endeavor forward.

Can an entrepreneur or business owner qualify for an EB-2 NIW?

Yes, an entrepreneur may qualify, but owning a business or forecasting job creation does not automatically satisfy the NIW requirements. The petition should establish the underlying EB-2 qualification, define a specific endeavor, demonstrate its prospective national importance, and show why the entrepreneur is well positioned to execute it. The evidence should connect the business model and projected impact to credible qualifications, progress, resources, and market conditions.

Can an EB-2 NIW petitioner self-petition?

Yes. A person requesting a national interest waiver may generally file Form I-140 on their own behalf. Because the requested waiver covers the job-offer and labor-certification requirements, a permanent U.S. employer sponsor is not required in the same way as a conventional employer-sponsored EB-2 case. Self-petitioning does not reduce the evidentiary burden or eliminate the need to qualify for both EB-2 and the national interest waiver.

A plan should avoid assuming that every small business is nationally important merely because it will employ workers. Where applicable, it should explain broader implications such as scalability, industry effects, underserved markets, critical infrastructure, innovation, regional significance, supply-chain benefits, dissemination, or alignment with documented national priorities.

Do financial projections prove that an NIW endeavor will succeed?

Financial projections do not prove future success and should not be presented as guarantees. They are planning estimates based on stated assumptions. Their value is in demonstrating that the operating model, funding, pricing, expenses, staffing, implementation strategy, and expected growth have been considered coherently. Projections are stronger when supported by existing revenue, contracts, letters of intent, pilot results, industry benchmarks, or other objective evidence.

Does NIW approval immediately provide a Green Card?

No. Approval of Form I-140 confirms approval of the immigrant petition, but permanent residence requires a separate adjustment-of-status or immigrant-visa process. The applicant’s priority date must be current under the applicable Visa Bulletin category, and the applicant must remain otherwise eligible and admissible. Visa availability can vary by employment category, country of chargeability, and monthly government allocations.

Premium processing is currently available for qualifying NIW Form I-140 petitions under USCIS procedures. Can a spouse and children be included in an EB-2 NIW case?

They are not included as co-petitioners on the principal applicant’s I-140.
